A dismissal may be declared unfair when the stated grounds are not proven or the applicable formal requirements are not met. For both sides, the outcome often depends on the evidence, the notice and the first strategic decisions.

Key points
  • The dismissal letter frames much of the later dispute.
  • The employee should review the grounds, final settlement, compensation and deadlines.
  • The company should verify evidence, proportionality and consistency before giving notice.

What unfair dismissal means

The assessment depends on whether the employer can prove the grounds and has complied with the applicable formal rules. In a disciplinary case the focus is on conduct and seriousness; in an objective dismissal it is on the stated economic, technical, organisational or production grounds.

A decision that appears reasonable may be weakened by a generic letter or inconsistent documents. A case-specific review is therefore essential.

If you are the employee

Keep the dismissal letter, payslips, final settlement, communications and related documents. Review the effective date, stated grounds, service, reference salary, compensation and any potentially protected circumstances.

The time limit to challenge a dismissal in Spain is short. The choice between negotiation, mandatory settlement proceedings and a claim should be made promptly after assessing evidence, risk, timing and realistic outcomes.

If you are the employer

Confirm that the grounds exist, are documented and are proportionate. Review precedents, previous messages, protected situations, selection criteria and the calculations involved.

A dismissal letter is not a generic template. It should explain the facts, dates, context and consequences clearly enough for the employee and an independent third party to understand the case.

Settlement and negotiation

Settlement can bring certainty, but it requires preparation. The amount matters, as do certificates, references, confidentiality, the exit date and unemployment-related documentation.

Effective negotiation starts by knowing what can be defended, what should be avoided and which terms protect each party’s position.

General information. General information only. Classification of a dismissal requires review of the documents, deadlines, salary, service and individual circumstances.
